1. About CinqStay

CinqStay is a curated hotel discovery and booking platform that specializes in the world's newest luxury hotels. CinqStay operates as an intermediary platform — we help you discover and book hotels, but we do not directly provide accommodation services.

2. Booking & Payment Processing

All hotel reservations made through CinqStay are processed and managed by our booking partner Nuitee Ltd., operating as liteAPI (the "Booking Partner").

Nuitee Ltd. acts as the merchant of record for all transactions. This means that:

• Payment processing is handled entirely by Nuitee Ltd. (liteAPI)
• Your booking contract is between you and Nuitee Ltd.
• Hotel reservation management, modifications, and cancellations are handled by Nuitee Ltd.
• Charges on your payment method will appear from Nuitee Ltd. or liteAPI

3. Limitation of Liability

CinqStay acts solely as a technology platform connecting guests with hotel inventory provided through our Booking Partner. As such:

• CinqStay is not liable for the hotel reservation itself, including but not limited to room availability, hotel service quality, overbookings, or property conditions
• CinqStay is not responsible for payment disputes, refunds, or chargebacks — these are handled by Nuitee Ltd.
• CinqStay does not guarantee the accuracy of hotel information, pricing, or availability displayed on the platform, as this data is sourced from third-party providers
• CinqStay is not a party to the booking contract between the guest and the accommodation provider

For any questions, issues, or requests regarding your booking — including cancellations, modifications, refunds, or complaints about the hotel — please contact our Booking Partner directly:

5. Content & Accuracy

Hotel descriptions, images, ratings, pricing, and availability information displayed on CinqStay are sourced from third-party data providers and hotels. While we strive for accuracy, CinqStay does not warrant that all information is complete, current, or error-free. Prices are subject to change and are only guaranteed at the time of confirmed booking.

6. Privacy

Personal information collected during the booking process (name, email, phone number) is shared with our Booking Partner (Nuitee Ltd.) solely for the purpose of processing your reservation. CinqStay does not sell personal data to third parties. Payment information is processed securely by Nuitee Ltd. and is not stored on CinqStay servers.

7. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from the use of CinqStay shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

8. Changes to These Terms

CinqStay reserves the right to update these terms at any time. Continued use of the platform after changes constitutes acceptance of the revised terms.
